Employment-Based Immigration: first Preference EB-1
You may be qualified for an employment-based, job first-preference visa if you are an alien of amazing capability, are an outstanding professor or scientist, or are a specific multinational executive or supervisor. Each occupational category has particular requirements that need to be met:
Your petitioning employer must be a U.S. employer and mean to utilize you in a supervisory or executive capability. The petitioner must have been doing business in the U.S. for a minimum of 1 year, as a legal entity with a qualifying relationship to the entity that used you abroad in a supervisory or executive capacity.
No labor certification is needed.
* Criteria for Demonstrating Extraordinary Ability
In order to demonstrate you have sustained national or international honor job and job that your accomplishments have been recognized in your field of know-how, you should either include evidence of a one-time accomplishment (significant internationally-recognized award) or 3 of the 10 listed requirements below (or comparable proof if any of the criteria do not easily use):
– Evidence of receipt of lower nationally or worldwide acknowledged rewards or awards for excellence
– Evidence of your membership in associations in the field which require exceptional achievement of their members
– Evidence of published material about you in professional or major trade publications or other significant media
– Evidence that you have been asked to judge the work of others, either individually or on a panel
– Evidence of your original scientific, scholarly, creative, athletic, or business-related contributions of significant significance to the field
– Evidence of your authorship of scholarly articles in professional or major trade publications or other significant media
– Evidence that your work has actually been shown at creative exhibits or showcases
– Evidence of your efficiency of a leading or vital function in recognized organizations
– Evidence that you command a high wage or other considerably high compensation in relation to others in the field
– Evidence of your commercial successes in the performing arts

** Examples of Documentary Evidence That a Person is an Exceptional Professor or job Researcher
In order to show you are an outstanding professor or scientist, you should consist of proof of 2 of the 6 noted criteria listed below (or equivalent evidence if any of the criteria do not readily apply):
– Evidence of invoice of significant prizes or awards for impressive achievement
– Evidence of subscription in associations that need their members to demonstrate outstanding accomplishment
– Evidence of released material in expert publications composed by others about the alien’s operate in the scholastic field

Application Process
Extraordinary Ability: You may use for yourself by submitting a Type I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. employer need to submit a Form I-140, Petition for Alien Worker. As part of the application process, your employer must be able to demonstrate a continuing capability to pay the used wage as of the priority date. Your employer may an annual report, federal tax return, or audited monetary declaration to demonstrate a continuing capability to pay your wage.
Multinational Manager or Executive: Your U.S. employer should file USCIS Form I-140, Petition for Alien Worker. As part of the application procedure, your company should be able to demonstrate a continuing capability to pay the used wage as of the concern date. Your company may use an annual report, federal income tax return, or audited financial statement to show a continuing capability to pay your wage.
